JOHN H. MARSHALL, CONFEDERATE SEAMAN
OF THE C.S. DIXIE
John Henry Marshall was the 7th son of Fountain and Anna (Clark) Marshall. It is not known (at this writing) if he was married or not. He was born in 1835 at his fathers farm on Belews Creek, Belews Creek District, Stokes Co., North Carolina.
There is some confusion about how exactly John Marshall a farmer from N.Central North Carolina, found his way to being crew on a Confederate "pirate" vessel. There was apparently some confusion in the family also at that time, because we have a copy of a "Request For Information About Prisoners" form, filed by his father Fountain and listing John H. Marshall as being a member of K Co., 21st Regiment N.C. but no such person is in the roster of that company. The records show that John H. Marshall was a prisoner at Fort Lafayette, New York Harbor from August to October 1861 and that he was "Sent to the Tombs" which at first lead us to believe he died. He did, later, but not at Fort Lafayette nor at *"The Tombs". (The New York City Main Jail is still referred to as "The Tombs" and is now used for records storage. )
The schooner DIXIE, built in Baltimore in 1855 as the H & J NEILD, was sold to Captain Thomas J. Moore in 1860. Moore was, by all accounts, something of a "wheeler-dealer". At the commencement of the war, Moore changed the ships name to DIXIE, and ran the blockade into Charleston. There he organized a stock company, sold the schooner to said stock company for $5,500 and then the company applied for and received a *"Letter of Marque'" from the Confederate Government on June 26th. The application stated that the armament would consist of 3 guns, and a ships company of 35, with Captain Moore commanding.
(Letters of Marque) (Mark) were used by countries to encourage private ship owners to become "privateers" and raid enemy commercial shipping which they were then allowed to sell with the sponsoring government generally taking a share of the proceeds. Thus benefiting in two ways. The gain in funds and the augmentation of a small Navy. )
On 23 July 1861, four days at sea, the DIXIE took (captured) the bark GLEN out of Portland Maine with a load of coal which netted the owners and crew of the DIXIE more than $10,000 in "prize" money when it was sold. Two days later at Lat. 29o N., Long. 77o 10', the DIXIE took the schooner MARY ALICE with a cargo of sugar bound for New York. Not wishing to return to port yet, Capt. Moore placed a "prize crew" aboard the MARY ALICE and continued on his way. However.... The MARY ALICE was retaken by the U.S.Navy Frigate WABASH later that same day and the prize crew from the DIXIE were sent to Fort Lafayette and charged with piracy along with crews of other Southern privateer vessels. This is how John H. Marshall became a prisoner of war.
The documents below (copied from originals) show an outline of the imprisonment of John H. Marshall. But, there is more to events than that. The Union Government fully intended to charge and try all the Confederate sailors as pirates which always meant a sentence of hanging. But far from discouraging Southern ship owners from applying for Letters of Marque', it merely added to the numbers (300 reported at the time). In fact a proposal was made from Liverpool England to outfit an iron clad and use it to set fire to New York City.
President Jefferson Davis had written a fiery letter of protest to President Lincoln on July 6, 1861, stating that for every Confederate sailor charged and executed as a pirate, a Union prisoner of war would be dealt "the same treatment and the same fate as shall be experienced by those captured on the Savannah". He soon had to repeat this threat of retaliation for the crews of the Dixie, York and others. An equal number of high ranking Union officers, held as prisoners by the South, were selected by lottery to be executed should any privateers be executed. This raised a great deal of outcry in both the North and the South, but it worked. Not one Confederate privateer was executed and all were removed to military prisons from the common jails they had been held in and received better treatment, eventually were exchanged as POWs. Thus John Henry Marshall was repatriated back to North Carolina.
The Marshall family branch in Illinois has no oral history about anyone other than Johns older brother Emanuel being lost in the War Between the States. We can only assume that John did eventually return home. Finding information on this son of Fountain and Anna has been a great deal of fun but it has also left some questions. Was John Elias Marshall named after this Great uncle by his father Elias Yancy? How did John wind up on the ship when he was supposed to have been in the Infantry? And....
How many families can actually be claim and prove (well, sort of) they have a pirate in the family?

In conformity therewith, I send to New York in charge of Acting Master R.O. Patterson, U.S. Navy, nine prisoners, vis; five, George C. Gladden, John H. Marshall, J.P.M. Calvo, Charles Forrester and John Gonzales, who belong to the Southern Pirate Dixie. And four;, Patrick McCarthy, John Williams, Archibald Wilson and James Riley. He (they, ed note) belonged to the Southern Pirate York. The last, J. Riley, is a deserter from the U.S. Marine Corps. He was a sergeant and deserted at Norfolk some year or so past.

and said that he was a railroad man." Further letter of 4 April 1995, in which Mr. Neal states that he was told by his father's Aunt, "that Uncle Dee lived in the Dodson Hotel in Walnut Cove, and his daughter played piano there. She was very good."
!Ruth Kramer in Illinois refers to him as "Uncle Dee" also. He visited the
Marshall's in Illinois. Richard D. Neal identifies himself as the Great-grandson of Mrs. Robert Pinkney (Mollie Ann) Neal who was a sister to Etta F. (James) Marshall, wife of W. Dewitt Marshall.

My grandfather Carl Jones Marshall was born in Stokes Co. in 1909, died in Suffolk Va in 1966
His father is William Wortz Marshall born in Stokes Co in 1889 & died in Suffolk VA in 1945. According to his obt. his parents were William Dewitt and Florence James Marshall of Stokes Co. I saw in your website there was a Willis Dewitt and Etta Florence James Marshall could they be my g-g grandparents?

A native of Stokes County, N.C., Mr. Marshall was a retired Norfolk and Western Railway Section foreman.
I think that this is more than likely the same person.

Alpha E. Marshall, C Company, 44th Volunteer Infantry, Philippine Insurrection. Born in June, 1877 near Taylorville, Christian County, Illinois. We know from the his army physical description that he had a 3/4 inch scar on his left upper lip and a couple on his thumbs. He was healthy and probably not a bad looking young man. He was 5' 5½" tall and weighted 122 lbs. He had a 35 inch chest, ruddy complexion, blue eyes, dark brown hair, and good teeth.
On September 5, 1899 Alpha was sworn into the U.S. Army (Vol.) by 1st Lt. Mattheas Crowley, 5th Infantry, USA in Springfield, Illinois. He was 22 years, 3 months old. From Springfield he was shipped to Fort Leavenworth, Kansas with other "new boots" and assigned to Training Company #3 on September 8. Monthly Muster Roll call cards were kept on each man, noting pay, sick call days, and any punishment meted out for infractions. His records indicate that Pvt. Marshall never needed punishment and he was on sick call only once from January 19 until January 21, 1900 for injuries "incurred in the line of duty."
By March, 1900, C Company, 44th Regiment, U.S. Volunteers Infantry, along with Pvt. Marshall was stationed at Tagbilaran, Bohlo Island, Philippines. By March 26 he was part of a detachment sent to Jagna, Bohlo Island under the command of Lt. Levack.
On August 31, 1900 Pvt. Marshall and others in "Charlie" Company were on patrol south of a village called Carmen, Bohlo. The enemy jumped them "in strength" and the fight was fast and nasty. The natives were not armed or equipped as well as the boys of the 44th, but they were fighting on home ground with poisoned darts covered with cobra venom, some old muzzle-loaders of Spanish make, a few stolen modern cartridge rifles, and the ever present, almost ubiquitous "bolo" which even babies seemed to carry in the Philippines.
Five days later on September 5, 1900, a detail sent out from the base, found the battle field. Pvt. Marshall was found along with the rest of the dead, both American and Philippine. His wounds were grievous, as a bolo of the Cebuan type is as deadly as a Scotts Claighmore or a cavalry saber was at Gettysburg. He died the instant he was struck. The detail recorded the names and buried the dead.
Pvt. Alpha E. Marshall, Company C, 44th Volunteer Infantry USA was buried in grave number 1 at a place approximately one mile south of Carmen, Bohlo Island, Republic of the Philippines, 25 yards west of a road that runs south from Carmen. No medals were issued, no taps played, or flag draped coffins displayed. Just a note with his personal effects was sent to his brother, Richard W. Marshall in Taylorville, Illinois in May, 1901.
The last entry in his military record is one that anyone would be proud to have on our tomb stone. "Character Excellent, Services Honest and True."

My grandfather Carl Jones Marshall was born in Stokes Co. in 1909, died in Suffolk Va in 1966
His father is William Wortz Marshall born in Stokes Co in 1889 & died in Suffolk VA in 1945. According to his obt. his parents were William Dewitt and Florence James Marshall of Stokes Co. I saw in your website there was a Willis Dewitt and Etta Florence James Marshall could they be my g-g grandparents?

Hi, my name is Karen Gerry Thomhave. My grandmother was Onie Pearl Marshall. I am thrilled to find a part of my heritage!!! Her parents were Willis Dewitt Marshall and Etta Florence James. Her husband was William Preston Gerry. I have always been told that Onie was born on May 4th, 1900. My father was William Macadoo Gerry (1918-1963) I barely know anything of my heritage due to my Dad's sudden, untimely death. We have only had brief and sporadic encounters with my relatives in Winston Salem. They are wonderful and I enjoyed their company, although only twice in my adult life. Lately I had been trying to find info on the internet. Seems as though I was getting a little push... I started to become so frustrated searching the Gerry line and today I finally decided the Marshall line may hold some promise as the name appeared often in the Moravian search I had found. I even sent out a prayerful plea to my ancestors to help me. Within 2 minutes I found your web-site! I was going to stop looking at all those names and go have a coffee, but decided to scroll a little more and EUREKA!!!! There they were! Thank you, thank you for this invaluable information. What an amazing person you must be to have researched all this. I just want to thank you for giving me and my entire family something to grasp and even hold onto after all these years of wondering. I have recentlly found some missing links in my marshall of Stokes co search.
My grandfather Carl Jones Marshall was born in Stokes Co. in 1909, died in Suffolk Va in 1966
His father is William Wortz Marshall born in Stokes Co in 1889 & died in Suffolk VA in 1945. According to his obt. his parents were William Dewitt and Florence James Marshall of Stokes Co. I saw in your website there was a Willis Dewitt and Etta Florence James Marshall could they be my g-g grandparents?
any help would be most appreciated

Hi, my name is Karen Gerry Thomhave. My grandmother was Onie Pearl Marshall. I am thrilled to find a part of my heritage!!! Her parents were Willis Dewitt Marshall and Etta Florence James. Her husband was William Preston Gerry. I have always been told that Onie was born on May 4th, 1900. My father was William Macadoo Gerry (1918-1963) I barely know anything of my heritage due to my Dad's sudden, untimely death. We have only had brief and sporadic encounters with my relatives in Winston Salem. They are wonderful and I enjoyed their company, although only twice in my adult life. Lately I had been trying to find info on the internet. Seems as though I was getting a little push... I started to become so frustrated searching the Gerry line and today I finally decided the Marshall line may hold some promise as the name appeared often in the Moravian search I had found. I even sent out a prayerful plea to my ancestors to help me. Within 2 minutes I found your web-site! I was going to stop looking at all those names and go have a coffee, but decided to scroll a little more and EUREKA!!!! There they were! Thank you, thank you for this invaluable information. What an amazing person you must be to have researched all this. I just want to thank you for giving me and my entire family something to grasp and even hold onto after all these years of wondering. Can't wait to tell my husband and daughter,my mom and 5 siblings. I have bits of info but not much. My Aunt Sandy is the only surviving child of Onie and William. I hope you will contact me. GRINDSTAFF WALKERTOWN Sandra Gerrey Grindstaff April 7, 1939 - Sept. 3, 2013 Mrs. Sandra Gerrey Grindstaff, 74, of Walkertown, NC, passed away on Tuesday, September 3, 2013 at Forsyth Medical Center. Sandra was born on April 7, 1939 in Forsyth County, NC to William Preston Gerrey and Onie Marshall Gerrey. She was a member of Oak Grove Moravian Church. Sandra retired from the Forsyth County Sherriff's Department. Mrs. Grindstaff was preceded in death by her husband, Bobby Joe Grindstaff; her parents; two brothers, William M. Gerrey and Lester J. Gerrey; and two sisters, Florence G. Boles and Mozelle G. Lewis. Mrs. Grindstaff is survived by her son, Baron Grindstaff and wife, Alison of Graham, NC and one grandson, Samuel E. Grindstaff of Graham NC. A funeral service will be held at 11:00 a.m. on Saturday, September 7, 2013 at Oak Grove Moravian Church with Rev. Matthew Allen officiating. Burial will follow in the church graveyard. The family will receive friends one hour prior to the service at the church. In lieu of flowers, the family requests that memorials be made to Hospice of Forsyth County, 101 Hospice Ln., Winston-Salem, NC 27103 or Oak Grove Moravian Church Choir Fund, 120 Hammock Farm Rd., Winston-Salem, NC 27105. The family asks that if you do insist on sending flowers, have them sent directly to the church Saturday morning.
